12/09/2019 Critical Incident Briefing


This is a "Critical Incident Briefing" of an officer involved shooting that took place on December 9, 2019 near the intersection of 43rd Avenue and McDowell Road in Phoenix. The shooting was a result of a call of shots fired in the area of 95th Avenue and Camelback Road. When officers arrived, they found one person who suffered a fatal injury. Officers later located the suspect near 43rd Avenue and McDowell Road. It was while officers were attempting to arrest him that the shooting occurred.

UPDATE:

Maricopa County Attorney's Office decision on the criminal investigation:

  • The Maricopa County Attorney's Office has reviewed the shooting incident that occurred on December 9, 2019 involving Glendale police officers. Based on the information submitted in the Phoenix Police Department report number 2019-2137525, it is in the opinion of the County Attorney that the officers involved in the shooting did not commit any act that warrants criminal prosecution.

Glendale Police Department decision on the internal investigation:

  • A disciplinary Investigation DI2019-089 was completed. A “Response to Resistance Panel” met on July 15, 2020 and the panel voted unanimously that the response to resistance used was justified and within policy. Based on this recommendation and all other evidence, the officers involved were exonerated of the allegation against them. For clarification purposes, the Glendale Police Department’s definition of “exonerated” means the investigation found that the incident occurred, but the conduct was lawful and proper.
